Terms of Use

This document constitutes the legally binding Terms and Conditions (“T&C”) agreement between ProfitMaxFX (“the Company”) and you (“the Client”) in connection with your use of ProfitMax FX’s online forex demo trading platform and related services (“the Services”). By accessing or using the Services, you acknowledge and agree to be bound by these T&C. It is important that you read and understand these T&C before proceeding.

Other Policies

These Terms do not alter in any way the Terms or Conditions of any other agreement you may have with us for products, services, programs or else. Additional policies and terms may apply to use of specific portions of a Site and to the purchase of certain services and are included as part of these Terms whether they reference these Terms or not. Other types of agreements and policies that you may be subject to include, but are not limited to:
– ProfitMax FX’s FAQs, as amended from time to time and which are incorporated by reference and made a part of these Terms. By agreeing to these Terms, you are agreeing to abide to all rules identified within the FAQ and other sources within the website.

– The Refund Policy – The Privacy Policy

  1. Client Eligibility 


    To access our Services, you must be at least 18 years old or of legal age in your jurisdiction. You should possess the legal capacity to enter into a contract with ProfitMax FX. Provide accurate and complete information during registration, as false information may lead to account refusal or termination. The Account is solely for your use and should not be shared with others.


  2. Evaluation Account Terms


    Our Evaluation accounts are designed for educational and testing purposes only. They are not live trading accounts and are subject to FOREX leverage, determined at our discretion.


  3. Trading Account 


    Upon successful registration, you’ll receive a unique trading account (“the Account”) to access our Services. Safeguard your Account login details and take full responsibility for all activities under your Account, as you are not allowed to share such credentials with other parties for any reasons (including but not limited to Challenge passing services, having someone else trading for you, trade from different  IP addresses at the same time ecc) as that will defeat the purpose of our challenge and lead to the termination of your Trading Account. Please note that the Account is a demo trading account intended for educational and testing purposes only. No actual financial transactions occur on the Account.


  4. Risks and Disclaimers 


    Forex trading carries substantial risks, and there is no guarantee of profit. Your trading decisions are solely your responsibility, and we do not provide financial or investment advice. Any information or recommendations we provide are for informational purposes only. Past performance is not indicative of future results.


  5. Liability Disclaimer 


    While we strive to provide a reliable platform, ProfitMax FX and its team are not liable for any direct, indirect, or incidental damages arising from your use of the Services. We are not responsible for losses, damages, or delays due to technical failures or third-party platforms used with our Services. You understand that your trading decisions are at your own risk.


  6. Indemnification 


    You agree to indemnify and hold ProfitMax FX, its directors, officers, employees, and agents harmless from any claims, liabilities, damages, losses, costs, and expenses related to your use of the Services or any breach of these T&C.


  7. Termination / Access Restriction 


    While we are thrilled to have you on our platform, ProfitMax FX reserves the right to terminate or restrict your access to our website and services at any time without notice. We may also modify or discontinue our website and services without notice. Access may be restricted if you violate these T&C or any rules on our FAQs section. Please note that termination or access restriction does not absolve you from any obligations or liabilities under these T&C.


  8. Confidentiality 


    We value confidentiality and expect you to do the same. Any information disclosed by ProfitMax FX is confidential and proprietary. You agree not to share or disclose such information without our written consent.


  9. Dispute Resolution 


    In the event of any disputes, we prefer open communication. However, if disputes cannot be resolved through dialogue, you agree to resolve them through binding arbitration. You waive your right to bring claims in court, including class action lawsuits, and agree to submit disputes to arbitration.


  10. Governing Law and Jurisdiction 


    These T&C are governed by the laws of the State of Florida, United States. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in the State of Florida.


  11. Changes to Terms and Conditions 


    At ProfitMax FX, we continuously strive for improvement. We may change these T&C from time to time, and your continued use of our website or services constitutes your acceptance of any changes.


  12. Entire Agreement 


    These T&C encompass the agreement between you and ProfitMax FX. By accepting these T&C, you acknowledge and agree to be bound by all provisions herein.
